NO PURCHASE NECESSARY. INTERNET ACCESS AND A VALID E-MAIL ADDRESS ARE REQUIRED TO ENTER. The Milk-Bone® BIRTHDAYS Sweepstakes (“Promotion”) begins on or about 9:00 AM Eastern Time (“ET”) on 04/04/2022 and ends at 11:59:59 PM ET on 03/31/2023 (“Promotion Entry Period”).
ELIGIBILITY: The Promotion is open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older at the time of Entry (“Entrant”). Employees of Big Heart Pet Brands, (“Sponsor”), and its parent company, The J.M. Smucker Company and each of their its respective affiliated and subsidiary companies, advertising, promotion, public relations, fulfillment and judging agencies and legal advisers and their respective officers, directors, agents, employees and assigns (collectively, the “Released Parties”) and all other service agencies involved with this Promotion, and members of the immediate families (parent, child, sibling and spouse) or households (whether or not related) of any of the above are not eligible to enter this Promotion. PROMOTION IS VOID OUTSIDE THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND WHERE PROHIBITED.
HOW TO ENTER: During the Promotion Entry Period, to enter, (i) visit https://www.milkbone.com/dog-birthdays/sweepstakes; and (ii) subscribe to the Milk-Bone® electronic newsletter by submitting your complete name, email address, zip code, and your dog’s name and birthdate and you will automatically receive one (1) Entry into the Promotion (i and ii, individually defined as “Entry” and collectively defined as “Entries”). All Entries must be received by 11:59:59 PM ET on 03/31/2023. Limit one (1) Entry by subscribing to the Milk-Bone® electronic newsletter per person, per email address during the Promotion Entry Period. Sponsor’s clock shall be the official timekeeping device to enter the Promotion. If you are entering this Promotion from your wireless device, data rates may apply. Check with your wireless provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. Not all wireless carriers participate. Use of automated devices is not valid for Entry. Any Entry that is submitted with the use of an automated device will be void. Mechanically reproduced or computer-generated Entry forms or Entries are ineligible and will be disqualified. Entries that are late, illegible, incomplete, unreadable, damaged, destroyed, delayed, lost, tampered with, incomprehensible, forged, misdirected, inaccurate, unintelligible or otherwise not in compliance with these Official Rules will be disqualified. Your Entry constitutes your consent to participate in this Promotion and your consent for Sponsor to obtain and deliver your email address, and other information, for the purpose of administering this Promotion and for other uses by Sponsor as permitted by applicable law. TWELVE (12) RANDOM DRAWINGS/SELECTION OF THREE HUNDRED AND SIXTY-SIX (366) PRIZE WINNERS: Three hundred and sixty-six (366) prize winners (“individually defined as “Prize Winner’’ and collectively defined as “Prize Winners” will be selected from among twelve (12) monthly random drawings (individually defined as a “Monthly Drawing” and collectively defined as “Monthly Drawings”). All Entries received as of one (1) day prior to each Monthly Drawing date listed below will be sorted by the month of the Dog’s birthdate listed on the Entry and the following number of Prize Winners will be selected in each Monthly Drawing listed below:
Monthly Drawing #1: All Entries that include a Dog’s birthdate in the month of June will be combined and thirty (30) Prize Winners will be selected. Monthly Random Drawing #1 will be conducted from among all Entries received between 04/04/2022 and 04/30/2022. Monthly Random Drawing #1 will be conducted on or about 05/01/2022 and winners will be notified by the email address submitted at the time of Entry on or about 05/01/2022.
Monthly Drawing #2: All Entries that include a Dog’s birthdate in the month of July will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #2 will be conducted from among all Entries received between 04/04/2022 and 05/31/2022. Monthly Random Drawing #2 will be conducted on or about 06/01/2022 and winners will be notified by the email submitted at the time of Entry on or about 06/01/2022.
Monthly Drawing #3: All Entries that include a Dog’s birthdate in the month of August will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #3 will be conducted from among all Entries received between 04/04/2022 and 06/30/2022. Monthly Random Drawing #3 will be conducted on or about 07/01/2022 and winners will be notified by the email address submitted at the time of Entry on or about 07/01/2022.
Monthly Drawing #4: All Entries that include a Dog’s birthdate in the month of September will be combined and thirty (30) Prize Winners will be selected. Monthly Random Drawing #4 will be conducted from among all Entries received between 04/04/2022 and 07/31/2022. Monthly Random Drawing #4 will be conducted on or about 08/01/2022 and winners will be notified by the email address submitted at the time of Entry on or about 08/01/2022.
Monthly Drawing #5: All Entries that include a Dog’s birthdate in the month of October will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #5 will be conducted from among all Entries received between 04/04/2022 and 08/31/2022. Monthly Random Drawing #5 will be conducted on or about 09/01/2022 and winners will be notified by the email address submitted at the time of Entry on or about 09/01/2022.
Monthly Drawing #6: All Entries that include a Dog’s birthdate in the month of November will be combined and thirty (30) Prize Winners will be selected. Monthly Random Drawing #6 will be conducted from among all Entries received between 04/04/2022 and 09/30/2021. Monthly Random Drawing #6 will be conducted on or about 10/01/2022 and winners will be notified by the email address listed submitted at the time of Entry on or about 10/01/2022.
Monthly Drawing #7: All Entries that include a Dog’s birthdate in the month of December will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #7 will be conducted from among all Entries received between 04/04/2022 and 10/31/2022. Monthly Random Drawing #7 will be conducted on or about 11/01/2022 and winners will be notified by the email address submitted at the time of Entry on or about 11/01/2022.
Monthly Drawing #8: All Entries that include a Dog’s birthdate in the month of January will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #8 will be conducted from among all Entries received between 04/04/2022 and 11/30/2021. Monthly Random Drawing #8 will be conducted on or about 12/01/2022 and winners will be notified by the email address submitted at the time of Entry on or about 12/01/2022.
Monthly Drawing #9: All Entries that include a Dog’s birthdate in the month of February will be combined and twenty-nine (29) Prize Winners will be selected. Monthly Random Drawing #9 will be conducted from among all Entries received between 04/04/2022 and 12/31/2022. Monthly Random Drawing #9 will be conducted on or about 01/01/2023 and winners will be notified by the email address submitted at the time of Entry on or about 01/01/2023.
Monthly Drawing #10: All Entries that include a Dog’s birthdate in the month of March will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #10 will be conducted from among all Entries received between 04/04/2022 and 01/31/2023. Monthly Random Drawing #10 will be conducted on or about 02/01/2023 and winners will be notified by the email address submitted at the time of Entry on or about 02/01/2023.
Monthly Drawing #11: All Entries that include a Dog’s birthdate in the month of April will be combined and thirty (30) Prize Winners will be selected. Monthly Random Drawing #11 will be conducted from among all Entries received between 04/04/2022 and 02/28/2023. Monthly Random Drawing #11 will be conducted on or about 03/01/2023 and winners will be notified by the email address submitted at the time of Entry on or about 03/01/2023.
Monthly Drawing #12: All Entries that include a Dog’s birthdate in the month of May will be combined and thirty-one (31) Prize Winners will be selected. Monthly Random Drawing #12 will be conducted from among all Entries received between 04/04/2022 and 03/31/2023. Monthly Random Drawing #12 will be conducted on or about 04/01/2023 and winners will be notified by the email address submitted at the time of Entry on or about 4/01/2023.
All Monthly Random Drawings will be conducted by PCG365, an independent judging organization whose decisions are final and binding in all respects to this Promotion. Odds of winning depend upon the number of Entries received. Sponsor shall have no liability for any Prize Winner notification that is lost, intercepted or not received by a potential prize winner for any reason.
THREE HUNDRED SIXTY-SIX (366) PRIZES AND THEIR APPROXIMATE RETAIL VALUES (“ARV”): Each prize is one (1) Milk-Bone® BIRTHDAYS Party Pack consisting of the following: (i) one (1) dog Boñata (ARV: $58.21); (ii) one (1) pup party hat (ARV: $1.15); (iii) one (1) HAPPY BIRTHDAY banner (ARV: $32.72); (iv) one (1) package of artificially flavored Milk-Bone® Birthday Cake Flavored Biscuits, 8 oz (ARV: $3.79); (v) one (1) package of Milk-Bone® Stacked Dog Biscuit, Molasses & Peanut Butter Flavor Filling Naturally & Artificially Flavored, 10 oz (ARV: $4.79); and (vi) one (1) package of Milk-Bone® Chews Flavor Twists Dog Chews — What’s Steak’n Bacon!, 4.23 oz (ARV: $6.49). Total ARV of each Prize: $107.15. TOTAL ARV OF ALL PRIZES: $39,216.90. Limit one (1) Prize per household.
GENERAL TERMS & CONDITIONS: Sponsor reserves the right, at Sponsor’s sole discretion, to substitute any Prize item of equal or greater value in the event that a Prize item is unavailable. Each potential Prize Winner will be required to return a Prize Verification Form and unless prohibited by law, a Publicity Release, within five (5) business days from date of issuance. Failure to submit any identification required by Sponsor or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of a Prize (or any portion thereof) or prize notification as undeliverable may result in disqualification and prize forfeiture and, at Sponsor’s sole discretion, may cause an alternate potential Prize Winner to be selected in a random drawing conducted from among all remaining eligible Entries. Prizes will be delivered within thirty (30) days following the completion of the Winner notification process. By entering this Promotion, all Entrants agree to release, hold harmless and indemnify the Sponsor, its affiliates, subsidiaries, agencies, judges, and each of their respective shareholders, directors, officers, employees or representatives from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorneys’ fees and court costs) arising directly or indirectly from or in connection with any Prize or resulting from participation in this Promotion or from acceptance, possession or use/misuse of any Prize or participation in any Prize-related activity or use by Sponsor of the Entry in any manner. Submission of an Entry and acceptance of any Prize will constitute and signify the Entrants agreement and consent (or that of a parent or legal guardian if Entrant is an eligible minor under applicable law) that the Sponsor and/or the Sponsor’s assignees may use the Entrant’s name, photograph, likeness and/or Prize information for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without time limitation and without further compensation, except where prohibited. All Prize Winners are solely responsible for any local, state, or federal taxes on Prize received. Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend the Promotion or void any Entry should a virus, bug, non-authorized human intervention, action of an Entrant or other cause corrupt or impair the administration, security or fairness of this Promotion.
Sponsor and the Released Parties are not responsible for any problems or technical, hardware, or software malfunctions of any network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Promotion, computer online systems, servers or providers, computer or other electronic equipment, software, failure of any e-mail or Entry to be received by the Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the Internet or any website, or any combination thereof, including, without limitation, any injury or damage to Entrant’s or any other person’s computer or other electronic device relating to or resulting from participating in this Promotion or uploading/downloading any materials in connection with this Promotion.
If, for any reason, this Promotion is not capable of running as planned by any cause which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Promotion, or if due to any technical, production or other error, more prizes are claimed or awarded than are described in these Official Rules at any prize level, Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend this Promotion and determine the winners from eligible Entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. No more than the number of prizes stated in these Official Rules will be awarded. By entering, Entrants agree and consent: (a) that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with this Promotion, will be resolved individually, without resort to any form of class action, and governed by, and construed in accordance with, the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules, and (b) to the jurisdiction and venue of the federal, state and local courts located in Cleveland, Ohio.
LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an Entrant, such Entry will be deemed to be made by the authorized account holder of the e‑mail address submitted at the time of entry. “Authorized account holder” is deemed as the natural person who is assigned to an e‑mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e‑mail addresses for the domain associated with the submitted e‑mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, mutilated, incomplete, or non-delivered Entries; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of Entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of this Promotion or website, may be acting in violation of the terms of the Website or the Official Rules or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of this Promotion is unlawful and subject to legal action by Sponsor or its agents.
IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THIS PROMOTION, INCLUDING ENTRANTS’ ACCESS TO AND USE OF THE PROMOTION WEBSITE OR DOWNLOADING FROM/UPLOADING TO AND OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE.
